UNSTRUCK SOUND NYC TERMS AND CONDITIONS

1. Introduction

These terms and conditions ("Agreement") set forth the terms under which Unstruck Sound NYC ("Company") provides Energy Healing Services and Certification Classes and Trainings ("Services") to its clients ("Clients"). By accessing or using the Services, Clients acknowledge and agree to abide by this Agreement. Please read this Agreement carefully before proceeding.

2. Services

2.1 Energy Healing Services: The Company offers various energy healing services, including but not limited to Reiki, Sound Healing, and Crystal Healing. These services aim to support and enhance Clients' physical, mental, and emotional well-being.
2.2 Certification Classes and Trainings: The Company provides certification classes and trainings for those seeking to become energy healing practitioners. Clients wishing to attend these classes must meet the prerequisites and satisfy the requirements outlined by the Company.

3. Client Responsibilities

3.1 Accuracy of Information: Clients agree to provide accurate and up-to-date personal information during the registration or booking process. The Company disclaims any liability arising from inaccuracies or omissions in the information provided by Clients.
3.2 Health Considerations: Clients acknowledge that the energy healing services provided by the Company are complementary and alternative methods of healing, not a substitute for professional medical advice or treatment. Clients should consult their healthcare provider before receiving any energy healing services, particularly if they have any existing medical conditions or concerns.
3.3 Consent to Touch: Clients understand that energy healing often involves physical contact from the practitioner in order to channel healing energies. Clients maintain the right to express physical boundaries and provide consent for any and all physical touching during sessions.
3.4 Confidentiality: Clients understand and agree to maintain the confidentiality of any proprietary information, teaching materials, techniques, or trade secrets shared during certification classes and trainings.

4. Payment and Cancellation

4.1 Fee Payment: Clients are responsible for paying the fees associated with the Services as specified by the Company. Payment methods accepted include cash, credit card, or electronic transfer, unless otherwise agreed upon by the Company.
4.2 Cancellation Policy: For Energy Healing Sessions including but not limited to Reiki, IET®, and 13th Octave LaHoChi, clients must provide a minimum of 24 hours' notice to the Company when canceling or rescheduling any appointment. Failure to do so will result in a $35 cancellation fee. For classes and certifications, once clients have registered and made the full payment, there is no possible cancelation.
4.3 Refunds: Refunds are at the sole discretion of the Company, and any requests must be made in writing within the specified refund period outlined by the Company for the respective Services. Refunds will incur the card processing fee and a $35 administrative fee.

5. Intellectual Property

5.1 Ownership: All intellectual property (including but not limited to logos, trademarks, course materials, manuals, and audiovisual content) provided by the Company remains the sole property of the Company. Clients may not reproduce, modify, distribute, or exploit any proprietary information without the explicit written consent of the Company.

6. Limitation of Liability

6.1 Exclusion: To the maximum extent permitted by applicable law, the Company disclaims all liability for any direct, indirect, incidental, consequential, or special damages arising from or in connection with the Services.
6.2 Indemnity: Clients agree to defend, indemnify, and hold the Company harmless against any claims, liabilities, losses, damages, or expenses arising from Clients' use of the Services or any breach of this Agreement.

7. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the state of New York, without regard to its conflict of laws principles. Any legal action or proceeding arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the state and federal courts located within the state of New York.

8. Modification and Severability

The Company reserves the right to modify any terms and conditions of this Agreement at its discretion. In the event that any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue to be effective.
By accepting these terms and conditions, Clients acknowledge that they have read, understood, and agreed to the terms set forth by Unstruck Sound NYC for the Energy Healing Services and Certification Classes and Trainings.

9. Privacy Policy
